Section A: General Terms for All Guests

Welcome to Nagoya is not boring (hereinafter referred to as “us”, ”we”, “our”, or “ours” as the context allows). By accessing or using our platform, https://www.nagoyaisnotboring.com/ operated by Nanobo Inc. (“Platform”) and our associated services, you (hereinafter referred to as the “Guest “or “you”, “your”, or “yours” as the context allows) agree to adhere to and be bound by the following terms and conditions “Terms”. We kindly request that you read these Terms carefully to ensure your understanding and compliance before using our Platform and registering to our services and Tours (defined below).

In addition to the Terms stated on this page, there are two other documents that form part of our contract with you:

  • The “About Us” page helps you use our Platform and understand our roles, mission, values, our partners, and more.
  • The specific terms of service and conditions applicable to each type of Tour on the “Experiences” page help you understand and use our Tour packages, including the terms and conditions that apply to each specific Tour package.

By accepting these Terms, you agree to all three documents. If you do not agree to any of these Terms, please refrain from using our Platform.

  1. Definitions

Unless defined otherwise these definitions used throughout these Terms shall have the following meanings:

  1. Host: An individual that develops and conducts Tours or Experiences available through our Platform.
  2. Guide: A trained professional engaged by us or a Host who leads Tours and provides informative commentary to Guests.
  3. Guest: This refers to you—an individual, traveler, or entity who books and participates in the Tours or Experiences offered by us.
  4. Experience: A unique activity or event designed to engage Guests in local culture and provide them with memorable interactions.
  5. Tour: A guided journey or Experiences organized by us, a Host, a third-party service provider or travel agencies or a collaboration between both.
  1. About these Terms
  1. By booking a Tour on the “Experiences” page of our Platform, you agree to these Terms and any other terms and conditions provided during the booking process.
  1. If any authority determines that any part of these Terms is unlawful, the remainder of these Terms will continue to apply.
  1. These Terms are structured as follows:
  • Section A: General Terms for All Guests.
  • Section B: Specific Terms for each type of Tour, including the specific terms of service and the terms and conditions applicable to each type of Tour, as detailed on the “Experiences” page of our Platform.
  • In the event of a discrepancy between the General Terms and Specific Terms, the Specific Terms shall take precedence.
  1. The original version of these Terms is in English. In the event of any dispute regarding these Terms or any inconsistency between the English version and any other language version, the English version shall apply, unless otherwise required by local law. You can change the language at the top of this page.
  1. Our Roles, Booking or Reservation
  1. Our role is to assist Guests in experiencing unique and authentic Tours and Experiences in Central Japan by organizing these Tours and connecting Guests with third-party service providers, Hosts, partners, or travel agencies. When you book a Tour, we are responsible for our Platform and for organizing the Tour; however, we are not responsible for the travel experience itself or for the services provided by third-party service providers, Hosts, partners, or travel agencies.
  1. Guests are responsible for their own transportation to and from the designated meeting venue before the Tour begins and after it is completed. When you book separate transportation, such as a bus, car rental, or other means of private or public transport, we are not responsible for the travel experience itself.
  1. For Hosted Tour and Hosted Experiences packages (see below) and Tailored-Made Tours (see below), we partner with Hosts and travel agencies that create the Tour plans and events. These partner Hosts and agencies are entirely independent parties. They do not control our Platform and are not part of our company. These companies operate their own platforms and will not act as our processing or service agents. 
  2. Requests for modifications to bookings (including changes to the date, time, or number of participants) are subject to availability and are not guaranteed but may be accommodated at our discretion.
  1. Our Platform
  1. Depending on the Tour packages, we obtain information from Hosts, partners, travel agencies, and service providers. While we strive to ensure the accuracy of this information, we cannot guarantee that everything is correct. However, we take reasonable care and act with professional prudence in managing the information displayed on our Platform. Our role is to assist in organizing a Tour or Experiences by connecting Guests with the relevant parties selected during the booking process. We are not responsible for any errors, interruptions, or omissions in the information unless caused by our gross negligence or material breach. Nonetheless, we will make every effort to correct such occurrences as soon as we become aware of them.
  1. We are constantly striving to improve your experience on our Platform. To achieve this, we may display different designs, wording, products, etc., to different users to gauge their reactions. As a result, some services and terms may not be visible during your visit to our Platform.
  1. Our Platform does not recommend or endorse any service provider or its products, services, facilities, vehicles, or other offerings.
  1. Service providers, Hosts, and/or travel agency partners are solely responsible for their own services.
  1. When making a booking, please ensure that all information relating to you, including payment and contact details, is accurate and up to date; otherwise, you may not be able to access the Tour or Experiences. You are responsible for the accuracy of all information provided to us when making a booking.
  1. We will display the offers available to you in the language we determine to be most suitable. You can change the language at any time.
  1. Unless otherwise specified, you must be 18 (eighteen) years of age or older to use the Platform or have the consent of a parent or guardian to make a booking or reservation for a Tour. By booking or making a reservation through our Platform, you confirm that you meet these requirements.
  1. About the Tours
  1. All Tours are offered by us are conducted in English, Spanish, German, and occasionally in Japanese. Guests may select their preferred language at the time of booking, subject to availability. If a selected language is not available for a specific Tour, we will notify the Guest and offer alternative language options or the opportunity to reschedule.
  1. Should Guests arrive more than 15 (fifteen) minutes late without prior notification to us or the assigned Guide or Host, the Tour will be canceled without the possibility of a refund.
  1. Data Collection and Use
  2. We collect the following personal information from Guests:
    • Full Name
    • Age
    • Address (including country)
    • Phone Number
    • Email Address

This information is securely stored in our database and may be shared with Hosts and Guides as necessary to ensure the safety and communication of Guests. We will not reuse your personal information or data collected, except for the purposes mentioned in these Terms and never for marketing purposes. We will also instruct Hosts and Guides not to reuse this data for any purposes other than to perform their roles in relation to the Tour. However, any further use of data beyond our knowledge by Hosts or Guides, despite such instructions not to reuse, is beyond our control and therefore not our responsibility.

For Tailor-Made Tours, the travel agencies are responsible for data collection from all the Guests, and we are unaware of how the travel agencies specifically manage or use the data.

  1. By participating in any Tour, Guests grant permission for us, the Guide, or the Host to capture and utilize photographic images for promotional purposes on our Platform and social media platforms, unless explicitly declined. You are required to indicate if you do not wish for us to use your photos when booking the Tour.
  1. In Case of Accidents

Guests are advised to maintain their own travel insurance. In the unfortunate event of an accident occurring during a Tour (e.g., food poisoning, injury), we will take appropriate measures to assist. Guests are required to report any incidents immediately to the Guide or Host. While we will provide support to the best of our effort, it is important to note that we are not liable for injuries or accidents that occur during the Tour unless caused by our gross negligence or willful misconduct.

  1. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of Japan. Any disputes arising out of or in connection with these Terms shall be resolved exclusively in the Tokyo district court of Japan.

  1. Modifications to Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting on our Platform. Continued use of our services following such modifications constitutes your acceptance of the revised Terms.

  1. Force Majeure 

In circumstances of Force Majeure the following applies:

  1. Definition: In these Terms, “Force Majeure” refers to any event or circumstance beyond our reasonable control, which prevents or delays the performance of our obligations under these Terms. This includes, but is not limited to, natural disasters, acts of God, war, terrorism, civil unrest, government restrictions, pandemics except for COVID-19 and its variant, health emergencies, labor strikes, or any other unforeseen events.
  2. Notification: In the event of a Force Majeure event occurrence, Guest or we (as applicable) shall notify the other party as soon as reasonably practicable not less than 7 (seven) hours after such Force Majeure event occurs. We will make all reasonable efforts to minimize the impact of the event on the delivery of our services.
  3. Impact on Services: If a Force Majeure event prevents or significantly hinders our ability to perform our obligations, we may, at our discretion:

a. Postpone the affected Tour, providing Guests with the option to reschedule at a later date.

b. Offer a full refund for the affected Tour if rescheduling is not feasible and if a full refund can be processed without incurring additional expenses to us.

c. Provide alternative arrangements, if available, to fulfill our obligations under these Terms.

Notwithstanding the above, if a Force Majeure event does not affect our ability to perform the Tour but limits Guests’ access to the area due to such Force Majeure event, and certain tickets, events, or Guide/Host schedules cannot be canceled, we may incur associated fees. These associated fees will need to be borne by the Guests.

  1. Limitations of Liability

We shall not be held liable for any damages, losses, or additional expenses, including indirect or consequential damages, incurred as a result of a Force Majeure event or events beyond our control. Guests acknowledge that they bear the risk associated with such events and agree that our liability is limited to the extent provided herein.

Our maximum aggregate liability arising from or related to our services or the Tour, whether in contract, tort, or otherwise, shall not exceed an amount equal to the total Tour package fees paid by the Guests. This cap on liability shall apply to all claims, damages, losses, liabilities, and expenses incurred under or in connection with our services. In no event shall we be liable for any indirect, special, consequential, incidental, punitive, or exemplary damages, regardless of the form of action.

SECTION B: SPECIFIC TERMS

The Tours and Experiences listed on the Experiences page of our Platform are classified into three categories:

  1.  Original Guided Tours and Experiences
  1. About: These Original Guided Tours and Experiences are exclusively conceptualized and designed by us and are offered as one-day tour or trip packages. Guests are required to remit the full amount of the Original Guided Tour fee online to us, based on the number of participants and the selected Original Guided Tour package.
  2. All Guides are engaged by us as contractors. As such, our liability is limited to the general liability insurance that covers our Guides during the Original Guided Tours. However, we will make every effort to instruct our Guides to perform their duties in a professional and responsible manner, in line with our company values and mission.
  3. Guests are responsible for their own transportation to and from the designated meeting venue before the Tour begins and after it is completed. We do not provide special pickup or drop-off arrangements to the meeting venue other than what is already included in the Original Guided Tour packages.
  4. Items included in the Original Guided Tour package, such as lunch and museum or event tickets, are clearly outlined on the booking page for each Original Guided Tour. Please read the terms and conditions carefully before making a booking. Any additional purchases that Guests wish to make must be paid for by the Guests.
  5. The Original Guided Tour availability is contingent upon our confirmation. If the Original Guided Tour cannot be confirmed due to the availability of third-party service providers, we will reschedule it to another available date. If rescheduling is not possible, a full refund will be issued to you based on the Terms herein.
  6. Original Guided Tours are offered weekly, with the duration depending on the specific Tour package. Certain Original Guided Tour and Experience packages, such as Sumo tournaments, Kabuki, and Geisha performances, are available on specific dates only.
  1. Hosted Tours and Hosted Experiences
  1. About: These Hosted Tours packages are developed and facilitated by a Host as our independent partner. We will serve as the intermediary, connecting Hosts and Guests to facilitate effective communication and coordination between them. The Host will take charge of organizing the Hosted Tour itinerary and plan, ensuring that all logistical details are managed efficiently. Additionally, the Host is responsible for the actions relating to the implementation of the Hosted Tours, adhering to the common business standards of professional service.
  1. Guests are required to pay the full amount of the Hosted Tour package online at the time of booking to secure their reservation. This payment process ensures a seamless transaction and confirms the Guest’s commitment to the Tour.
  1. The confirmation of this Hosted Tour is contingent upon the Host’s acceptance of the booking. Guests will receive timely notifications within less than 5 (five) business days as from the booking date regarding the status of their booking, ensuring transparency and clarity throughout the process.

4.    Refund Policy: If the Hosted Tour is not confirmed, a full refund will be provided to the Guest. Payments to Hosts are processed via bank transfer following the completion of the Experience, generally on the 25th of the subsequent month.

  1. Our arrangement with the Host is based on a commission structure for facilitating the booking. Therefore, our liability is limited solely to these roles and does not extend beyond this scope.

III. Tailor – Made Tours

  1. About: For these Tailor-Made Tours, we are engaged by independent travel agencies to collaborate. The travel agencies will handle direct communication with Guests regarding the Tour packages. Our role is limited to planning and organizing specific aspects of the Tours requested by these agencies and providing Guides upon their request. Due to the nature of these Tailor-Made Tours, all payments shall be made directly through the travel agencies. We will subsequently invoice the agency to receive our fee.
  1. Tailor-Made Tours may span from a single day to multiple days and encompass several cities, with detailed itineraries designed by the specific travel agencies. If and when requested, we are only responsible for assisting with aspects of the Tour in Central Japan area.
  1. Pricing for these Tours varies based on the number of participants, duration of guiding services, activities included, and additional services such as station or hotel pickups.
  1. For all inquiries and communication, Guests should reach out directly to the travel agencies.
  1. Data Collection: For Tailor-Made Tours, we do not collect data directly from Guests. Instead, the travel agencies are responsible for gathering Guests’ information. Similar to other Tour packages, we will not reuse any data or personal information we receive from travel agencies, other than to perform our tasks related to the specific Tour.
  1. Payments
  1. Payments for Original Guided Tours and Hosted Tours are processed securely online via credit card through either Stripe or PayPal.
  2. Each Tour features a dedicated payment link. For customized Tours, a unique payment link will be generated specifically for the Guest.
  3. For Tailor-Made Tours, all payments shall be made directly through the travel agencies. We will subsequently invoice the agency to receive our fee. 
  1. Cancellation Policy

Original Guided and Hosted Tours and Experiences:

  • When a cancellation is made 7 (seven) or more days prior to the scheduled Tour date, you will receive a full refund of the paid Tour fee, minus a 5 % (five percent) processing fee.
  • When a cancellation is made between 3 (three) to 6 (six) days prior to the scheduled Tour date, you will receive a 50 % (fifty percent) refund of the paid Tour fee.
  • When a cancellation is made 48 (forty-eight) hours or less prior to the scheduled Tour date, no refund will be given.

Customized Original Tours and Tailored Tours:

  • Cancellations made 30 (thirty) or more days prior to the scheduled Tour date will incur a 10% (ten percent) fee.
  • Cancellations made between 15 (fifteen) to 29 (twenty-nine) days prior to the scheduled Tour date will incur a 35% (thirty five percent) fee.
  • Cancellations made between 14 (fourteen) to 4 (four) days prior to the scheduled Tour date will incur a 50% (fifty percent) fee.
  • Cancellations made within 3 (three) days of the scheduled Tour date will be subject to a 100% (one hundred percent) cancellation fee.

All refunds will be processed within a timeframe of 5 (five) to 10 (ten) business days through the payment methods used by the Guests.
